1. I’m only suffering from sore muscles, my doctor said it is just a strain and that I’ll be O.K. What does the research show?

Charles Carroll, M.D., Paul McAtee, M.D., and Lee Riley, Jr., M.D. in their article “Objective findings for the diagnosis of whiplash” in the Journal of Musculoskeletal Medicine noted that “the amount of damage to the automobile bears little relation to the force applied to the cervical spine of the occupants. The acceleration of the occupant’s head depends on the force imparted, the moment of inertia of the struck vehicle, and the amount of collapse of force dissemination by the crumpling of the vehicle.”

Gargan and Bannister reported a late onset of neck pain, extremity pain or paresthesia, interscapular pain, tinnitus, headache, dizziness, and visual disturbance after one week. Between three months and one year post accident, another 22% deteriorated, lending further support to the two phase phenomenon as described by Bring and Westman. Nerve damage (perineural fibrosis) can lead to Carpal Tunnel Syndrome up to two years later.

2. What do I need to know if I think I’ve been injured?

You need to know that you have rights, and that you may not be aware of what those rights are. You also need to know that most doctors are not trained in treating soft tissue injuries. Soft tissue injuries are usually more dangerous than a broken bone. Broken bones can heal up pretty well. Soft tissues heal with scar tissue. Scar tissue (fibrosis of repair) can affect tendons, ligaments, discs, joints, nerves, blood supply, lymph nodes, range of motion, muscle strength, and can rapidly speed up the degenerative processes of the spine known as Post Traumatic Osteoarthritis.

3. When do I need an attorney?

There have been reports recently of insurance companies contacting accident victims immediately after an accident. The companies tell the victims they want to help and ask them to quickly settle their claim. If you’re in an accident and this happens to you, ask yourself, who is the insurance company really trying to help?

It is my opinion that using a lawyer is a wise choice since lawyers can help clients get all the money they are entitled to after an accident. Most accident victims don’t know all their rights, or all they are entitled to under an insurance policy. The insurance industry’s own research shows that car accident victims receive more money when represented by a lawyer.

4. Should I be talking to the other side’s insurance company?

I recommend to all my patients to have the insurance company call me to answer any questions regarding the their condition, diagnosis, range of motion and X-ray findings.

5.Is going to the hospital and taking a pill all I need?

Absolutely Not!! If after a thorough evaluation I find that your injuries are minor in nature then you can be sure you will be O.K. But, if you’re in enough pain to take medication then chances are you suffered a soft tissue injury.

6. If I don’t have medical coverage on my policy, can I still get care?

Yes! If you were a victim, then the other side is liable, and will pay all your medical bills. Our office takes care of the paperwork and you are not billed.

7. Why can’t the other insurance company just pay my bills directly?

It is usually customary for the other insurance company to wait until the doctor is done treating and then they may pay the bill. So as long as the patient has an attorney who will settle the case and pay the bills for the patient, the doctor will treat the patient.

8. Suppose the person that hit me is uninsured, can I still get care?

Yes, your uninsured motorist portion of your policy will pay for care.
